1. KEY CONCEPTS<\/span><\/p>\n

1.1. The Company or Personal Data Controller is MB Siulai tau, a small partnership established and operating under the laws of the Republic of Lithuania, with legal entity code 306321763, registered office address K. Donelai\u010dio g. 57-1, Kaunas.<\/span><\/p>\n

1.2. Client or Data Subject \u2013 a natural person \u2013 a client of the Company (including website visitors) whose personal data is collected by the Company.<\/span><\/p>\n

1.3. Electronic store \u2013 the Company\u2019s electronic store at <\/span>http:\/\/www.happyinaknit.com<\/span><\/a> \u00a0<\/span><\/p>\n

1.4. Services \u2013 all services provided by the Company.<\/span><\/p>\n

1.5. Personal data \u2013 any information relating to a natural person \u2013 a Data Subject whose identity is known or can be determined, directly or indirectly, by reference to data such as an identification number, one or more specific physical, physiological, psychological, economic, cultural or social characteristics specific to that person.<\/span><\/p>\n

1.6. Personal data processing \u2013 any operation performed on personal data: collection, recording, accumulation, storage, classification, grouping, combination, alteration (supplementation or correction), provision, publication, use, logical and (or) arithmetic operations, search, dissemination, destruction or any other operation or set of operations.<\/span><\/p>\n

1.7. Partner \u2013 a legal entity that provides services to the Company related to the activities carried out by the Company, or sells goods to it, or carries out joint projects with the Company, including, but not limited to, marketing promotions, joint sales campaigns, loyalty programs, etc., in media, websites, the Online Store, retail stores, shopping chains, etc.<\/span><\/p>\n

1.8. A cookie is a small piece of text information that is automatically created when browsing a website and is stored on the visitor's computer or other device.<\/span><\/p>\n

1.9. Direct marketing \u2013 an activity intended to offer goods or services to individuals by mail, telephone or other direct means and\/or to ask for their opinion on the goods or services offered.<\/span><\/p>\n

1.10. Privacy Policy \u2013 means this document establishing the principles and rules for processing Personal Data when using the services of the Online Store.<\/span><\/p>\n

1.11. Account \u2013 the Customer's basic login data to the Online Store, consisting of one email address and Password.<\/span><\/p>\n

1.12. Password is a unique combination of numbers, letters, or numbers and letters or other symbols created by the Customer, which, after entering, allows access to the Online Store.<\/span><\/p>\n


2. GENERAL PROVISIONS<\/b><\/p>\n

2.1. The Client grants the Company the right to perform all Personal Data processing activities within the scope and for the purposes provided for in this Privacy Policy.\u00a0<\/span><\/p>\n

2.2. Personal data is processed in accordance with the Law of the Republic of Lithuania on the Legal Protection of Personal Data and other legal acts regulating the processing and protection of Personal data, as well as this Privacy Policy.<\/span><\/p>\n

2.3. Personal data is processed in the Company in accordance with the following principles:<\/span><\/p>\n

2.3.1. Personal data is collected for specified and legitimate purposes;<\/span><\/p>\n

2.3..2. Personal data is processed accurately, fairly and lawfully;\u00a0<\/span><\/p>\n

2.3..3. Personal data are adequate and limited to the extent necessary for their collection and further processing;<\/span><\/p>\n

2.3..4. Personal data is constantly updated;<\/span><\/p>\n

2.3..5. Personal data shall be stored in a form that permits identification of the Data Subject for no longer than is necessary for the purposes for which the data were collected and processed.<\/span><\/p>\n

2.3..6. All information about Personal Data is confidential;<\/span><\/p>\n

2.3..7. The Client's Personal Data and personal information will not be used for unlawful purposes.<\/span><\/p>\n

2.4. It is considered that the Customer, when making a purchase in the Online Store, has read the current version of the Privacy Policy and agrees with it. If the Customer does not agree with any part of the Privacy Policy or the Privacy Policy, in such case the Customer must not place an order and not purchase the goods in the Online Store.\u00a0<\/span><\/p>\n

2.5. The Privacy Policy can be viewed in the Online Store and printed at any time. The Privacy Policy may be changed, supplemented or updated at the discretion of the Company. A new version of the Privacy Policy is published in the Online Store.\u00a0<\/span><\/p>\n

2.6. The Customer may place an order in the Online Store without registration, or by registering in the Online Store through his\/her Account.\u00a0<\/span><\/p>\n

2.7. During the initial registration with the Online Store through the Account, the Customer must provide their email address and create a secure Password, as well as provide accurate Personal Data to the Online Store. The Customer is responsible for their accuracy. After creating an Account, the Customer is given an identification code.\u00a0<\/span><\/p>\n

2.8. When using the Services, as well as when making purchases in the Online Store, the Customer must always provide accurate Personal Data to the Online Store and is responsible for their accuracy.<\/span><\/p>\n

2.9. The Customer has the right to change and supplement Personal Data in the Account at any time or to contact the online store with a request to delete the Account.<\/span><\/p>\n

2.10. The Client must not disclose the Password to third parties and must keep it safe, otherwise all related liability shall lie with the Client.

3. COLLECTION, USE, CORRECTION AND STORAGE OF PERSONAL DATA<\/strong><\/p>\n

3.1. The Company respects the right of each Client to privacy. The Client's Personal Data (i.e. name, surname, e-mail address, telephone number, delivery address of the goods\/services, age\/year of birth, payment details for the goods\/services (bank account number, payment method, etc.), purchase history, and also, with the Client's consent, age, gender, date of birth, place of residence) are collected and processed for the following purposes:<\/span><\/p>\n

3.1.1. For the purpose of electronic commerce. The following Personal Data are processed: name, surname, e-mail address, telephone number, delivery address of the goods\/services, age\/year of birth, IP address, payment details for the goods\/services. The storage period of Personal Data used for the purpose of electronic commerce is 5 (five) years from the date of the last connection to the Electronic Store.<\/span><\/p>\n

3.1.2. For the purpose of direct marketing. The following Personal Data are processed: name, surname, telephone number, e-mail address, address, age, gender, date of birth, place of residence. The storage period of Personal Data used for the purpose of Direct Marketing is 5 (five) years from the date of the last connection to the Online Store.<\/span><\/p>\n

3.2. The Client may provide consent to the processing of his\/her Personal data (name, surname, telephone number, e-mail address, address, age, gender, date of birth, place of residence) for the purpose of Direct Marketing. If, having provided consent to the processing of his\/her data for the purpose of Direct Marketing, as well as to receive Direct Marketing messages, the Client later no longer wishes to do so and informs the Company thereof, the Company will no longer process his\/her Personal data for the purpose of Direct Marketing and will not send the Client any electronic news, except for information related to the Client's order.<\/span><\/p>\n

3.3. The Client has the right to withdraw his\/her consent to the Company processing the Client's Personal Data for Direct Marketing purposes, as set out in clause 3.2, at any time by submitting a relevant notification to the Company by e-mail. <\/span>info@happyinaknit.com<\/span><\/a>\u00a0 and clearly indicating that he withdraws his consent to the use of his Personal Data for Direct Marketing purposes and does not wish to receive any Direct Marketing communications.\u00a0<\/span><\/p>\n

3.4. The Client also has the opportunity to refuse to exercise his\/her right to object to the processing of the Client's Personal Data for Direct Marketing purposes by clicking on the relevant link in each email sent.<\/span><\/p>\n

3.5. The Client, as a Data Subject, has the following rights related to the processing procedures of the Client's Personal Data:<\/span><\/p>\n

3.5.1. receive information from the Company about the processing of the Client's Personal data, familiarize yourself with your Personal data and how they are processed;<\/span><\/p>\n

3.5.2. receive information from the Company about the sources and types of the Client's personal data collected, the purpose for which they are processed, and the recipients to whom the data is provided and has been provided for at least the last 1 (one) year;<\/span><\/p>\n

3.5.3. demand correction, destruction of the Client's Personal Data or suspension, except for storage, of the processing of their Personal Data, when the Personal Data is processed in violation of the provisions of the Law on the Legal Protection of Personal Data of the Republic of Lithuania and other laws.<\/span><\/p>\n

3.6. When exercising his rights, the Client must provide a passport, identity card or driver's license. The Company provides the Data Subject with information about the Personal Data of the Data Subject being processed free of charge once a year. The Client may exercise his rights provided for in clause 3.5 by contacting the e-mail address info@happyinaknit.com. The Company has the right to correct, change, delete Personal Data or suspend the processing of Personal Data only after identifying the identity of the Client who applied.\u00a0<\/span><\/p>\n

3.7. The Client's Personal Data is not provided to third parties, except in the following cases:<\/span><\/p>\n

3.7.1. When the Client's consent has been obtained, as specified in this Privacy Policy;<\/span><\/p>\n

3.7.2. Personal data for e-commerce purposes is provided to Partners who provide services to the Company related to the activities carried out by the Company;<\/span><\/p>\n

3.7.3. In cases provided for by the laws and legal acts of the Republic of Lithuania, to competent institutions.<\/span><\/p>\n

3.7.2.<\/span> In the online store, payments are processed using <\/span>makecommerce.lt<\/span><\/a> platform managed by Maksekeskus AS (Liivalaia 45, Tallinn 10145, Estonia, reg. no.:12268475), therefore your personal information required for payment execution and confirmation will be transferred to Maksekeskus AS.<\/span><\/p>\n

3.8. The Client is aware of his\/her right to object to the processing of his\/her Personal Data for Direct Marketing purposes, i.e. the Client has the right to express his\/her objection immediately or later.<\/span><\/p>\n

3.9. The Client agrees that his\/her Personal Data will be transferred to Partners when fulfilling the Client's order placed in the Online Store, as well as when the Company provides Services to the Client, as well as to the Company's Partners, as specified in clause 3.7.<\/span><\/p>\n

3.10. If the Customer does not agree to the Privacy Policy, the Customer will not be able to use the services of the Online Store.\u00a0<\/span><\/p>\n

3.11. The Company implements organizational and technical measures to protect Personal Data from accidental or unlawful destruction, alteration, disclosure, as well as from any other unlawful processing.\u00a0<\/span><\/p>\n

3.12. The Client agrees that in cases where it is necessary according to the instructions of the competent authorities and\/or the Client's Personal Data has been potentially used in the course of illegal activities, or there are reasonable suspicions of identity theft, due to which the competent law enforcement authorities are conducting a pre-trial investigation, or there are other legitimate grounds or purposes, his Personal Data would be stored on the Company's servers for a longer period than set out in this Privacy Policy.\u00a0<\/span><\/p>\n

3.13. Upon receipt of an instruction or inquiry from the Data Subject related to the processing of Personal data, the Company shall provide the Client with a response, satisfying the request\/instruction or with a reasoned refusal to do so, no later than within 30 (thirty) calendar days from the date of the Data Subject's request. If the Data Subject so requests, the response shall be provided in writing.\u00a0<\/span><\/p>\n

3.14. In order for the Company to offer the Customer full-fledged services in the Online Store, with the Customer's consent, information called Cookies is recorded on the Customer's computer (device).\u00a0<\/span>cookies<\/span><\/i>), which is used to identify the Customer as a previous user of the Online Store, to collect statistics on the attendance of the Online Store, information about the shopping cart. The Customer can at any time review which Cookies are being saved and can delete some or all of the saved Cookies.\u00a0<\/span><\/p>\n

4.1. The Company has the right to change or supplement the "Privacy Policy" in whole or in part. Supplements or amendments to the Privacy Policy shall enter into force on the date of their publication.<\/span><\/p>\n
